Rivers State High Court Dismisses Fundamental Rights Suit Against Eze Sergeant Awuse
A Rivers State High Court sitting in Port Harcourt has dismissed a fundamental rights enforcement suit filed against the Paramount Ruler of Emohua Kingdom, Eze Sergeant Chidi Awuse. The suit, which was instituted by Eze Godspower Onuekwa and prominent members of the Rumu-Mgboh Family of Rumuche Community in Emohua Local Government Area of Rivers State, sought to challenge the monarch over alleged rights violations.
The applicants had approached the high court seeking various reliefs and judicial declarations against the first-class monarch, who also serves as a key figure in the South-South Traditional Rulers forum. The suit joined other parties and sought to restrain the traditional ruler and his representatives from actions the applicants deemed to be an infringement on their constitutional rights.
The Court’s Ruling
Delivering judgment on the matter, the presiding judge dismissed the suit in its entirety, citing a lack of merit. The court held that the claims presented by the Rumu-Mgboh family did not fall within the purview of fundamental human rights enforcement as protected under Chapter IV of the 1999 Constitution of the Federal Republic of Nigeria (as amended). Legal analysts note that disputes of a communal or territorial nature cannot simply be repackaged as fundamental rights enforcement cases to bypass standard civil litigation processes.
The judge agreed with the defense counsel that the application was an abuse of court process and lacked the requisite legal standing under the Fundamental Rights (Enforcement Procedure) Rules. Consequently, the court struck out the suit, resolving all issues in favor of Eze Sergeant Chidi Awuse.

Allies of Eze Sergeant Chidi Awuse welcomed the court’s decision, calling it a landmark victory that reinforces the dignity, integrity, and authority of the Emohua traditional stool. Spokespersons for the community expressed hope that this judicial resolution will bring an end to internal friction and pave the way for sustainable peace and development in Rumuche and the wider Emohua Kingdom.
Meanwhile, legal representatives for the Rumu-Mgboh family have yet to issue an official statement on whether they intend to appeal the High Court’s ruling. For now, the decision remains a significant legal vindication for one of the region’s most prominent traditional leaders.
