An Ekiti State High Court sitting in Ado-Ekiti has nullified the Peoples Democratic Party (PDP) local government congress conducted in May 2025, declaring it a violation of both the party’s constitution and the Electoral Act.
In a ruling delivered on Friday, the presiding judge, Justice Bamidele Omotosho, affirmed the validity of the ward congress held earlier on March 15, 2025, during which new executives emerged across the state’s 177 wards.
Justice Omotosho ruled that the May congress was conducted in contravention of relevant legal and constitutional provisions, describing the process as illegitimate and nullifying all its outcomes.
“The Supreme Court has held that it is an elementary principle that no suit based on a charlatan claim must be acted upon by the court,” the judge said.
The court further declared that the claimant is the duly elected chairman and delegate of Ward 1 in Ado-Ekiti Local Government, as established in the PDP’s guidelines and evidence presented.
“I declare invalid, and it is hereby set aside, the purported list of delegates submitted by the defendants to the first, second, and third defendants, in contravention of Sections 2, 15(2)(3), and 49 of the PDP guidelines, and in breach of Sections 82 and 83 of the Electoral Act, 2022, and the PDP Constitution,” Justice Omotosho ruled.
The court issued a perpetual injunction restraining the PDP or its agents from recognizing or acting upon the disputed list of delegates arising from the nullified LG congress.
It also warned against acts of impunity and disobedience to court orders:
“No one shall undermine the authority of this order. The actions taken in contempt of this court’s prior restraining order specifically the congresses conducted during the pendency of the suit are hereby nullified, voided, and set aside.”
The ruling is expected to reset the party’s internal structure in the state ahead of the 2026 governorship election.
Reacting to the judgment, PDP chieftain Funsho Ayeni commended the court, saying it offers the party an opportunity to reconcile and reorganize.
“This ruling gives us a fresh chance to reunite and reposition the PDP for growth and electoral success,” he said, urging party leaders to close ranks.
Ayeni called on stakeholders to work together to strengthen the party’s base and strategize to defeat the All Progressives Congress (APC) in the forthcoming June 20, 2026 governorship election.
